Court of International Trade Remands Antidumping Duty Review of Chinese Shrimp

The Court of International Trade today issued a remand for the Commerce Department to revisit its selection of the Chinese companies used to set the antidumping duty rates in the fourth administrative review of that order. Picard Kentz & Rowe brought the case on behalf of the Ad Hoc Shrimp Trade Action Committee (“AHSTAC”), an association of domestic producers of frozen warmwater shrimp. Chief Judge Pogue directed the agency to better explain or otherwise reconsider its decision that did not address AHSTAC’s valid concerns. Remand results are due in October.

U.S. Supreme Court Brief Filed in Zeroing Case

Picard Kentz & Rowe today filed a U.S. Supreme Court brief on behalf of the Southern Shrimp Alliance and the Coalition for Fair Lumber Imports as amici curiae (“friends of the court”). They ask the Court to take an appeal filed by U.S. steel companies challenging the Commerce Department’s authority to stop “zeroing” in antidumping investigations by offsetting dumped sales with sales made above fair value — causing duties to drop or disappear. This issue is critical to the domestic shrimp and lumber industries. Both had antidumping investigations when the agency interpreted the statute to require zeroing, and both are harmed by its reversal in response to the World Trade Organization. Four Justices must agree to take the case.

The International Trade Commission Votes Affirmatively to Continue Antidumping Orders on Frozen Warmwater Shrimp

As part of the International Trade Commission’s (“ITC”) statutorily-mandated sunset review process, Commissioners voted 5-1 on March 15 to continue existing antidumping duty orders on frozen warmwater shrimp from Brazil, China, India, Thailand, and Vietnam. Trade relief has been in place since 2005 in order to offset the unfairly low prices of shrimp imports from those countries.

Picard Kentz & Rowe serves as counsel to the Southern Shrimp Alliance (“SSA”) which, through the Ad Hoc Shrimp Trade Action Committee, filed the petitions in the original investigations, and has defended the orders since they were put in place, including in the recent sunset review. As part of its defense of the orders, SSA and its counsel also have worked extensively with numerous government agencies on their enforcement, including significant anti-circumvention efforts.

Kentz Discusses Changes in Dumping and Subsidy Methodology at Georgetown University’s 2011 International Trade Update

Andrew W. Kentz recently served as an expert panelist at Georgetown University Law Center’s 2011 International Trade Update on March 4, 2011. Andrew discussed the Department of Commerce’s recent proposals to alter the administration of antidumping and countervailing duty laws, presenting his paper entitled “Changes in Dumping and Subsidy Methodology.”

Kentz Appointed Treasurer and Executive Committee Member of Lawyers’ Committee for Civil Rights Under Law

Andrew W. Kentz was recently appointed Treasurer and Executive Committee Member of the Lawyers’ Committee for Civil Rights Under Law. Andrew has been working with the Lawyers’ Committee for nearly a decade serving as Member of the Board of Directors. The main objective of the Lawyer’s Committee is to secure equal justice under law by utilizing the skills and resources of the bar to obtain equal opportunity for minorities by addressing factors that contribute to racial justice and economic opportunity. Kentz Moderates International Trade Panel at American University

On March 15, 2010, Partner Andrew W. Kentz participated in American University Washington College of Law’s event, The Changing Business Landscape, organized by the Business Law Brief, a student run publication that discusses fusion of the legal and business worlds. The event focused on the current business climate given the collapse of financial markets and sub-prime mortgage crisis, and evaluated the effects on intellectual property rights, international trade, private equity investment, and white collar crime. Andrew moderated a panel entitled, “International Trade: An Overview of Current Trends in Trade Flows, Negotiations and Enforcement” with representatives from the Office of the U.S. Trade Representative, Trade Winds LLC, and the Embassy of Brazil.

Yocis Serves as Panelist at Georgetown University’s 2010 International Trade Update

David A. Yocis, Counsel at Picard Kentz & Rowe, was a member of the “Key Subsidies Developments” expert panel at the at Georgetown University Law Center’s 2010 International Trade Update program on February 26, 2010. David was commenting on his paper entitled, “Subsidy Discipline in the Time of Bailouts.” The paper examines the role of subsidies and government bail-outs in the current economic climate, as well as issues that arose during the WTO Airbus and Boeing disputes.
